1. Statement of Exemption

The record-keeping requirements of 18 U.S.C. § 2257, 18 U.S.C. § 2257A, and the regulations issued thereunder at 28 C.F.R. Part 75 apply to visual depictions of actual human beings engaged in actual or simulated sexually explicit conduct, and require records identifying the performers portrayed.

All visual content on the RealMirage platform is wholly synthetic and generated entirely by artificial intelligence systems. No visual content on the Platform depicts any actual human being. No performers, models, or actors exist in connection with any visual content on the Platform, and accordingly no records of the kind contemplated by those provisions can or do exist.

Because the Platform's visual content contains no depictions of actual human beings, the record-keeping and labeling regime of § 2257 and § 2257A is inapplicable to that content by its own terms.

2. Prohibition on Real-Person Content

The exemption described above rests on a rule the Platform enforces absolutely: RealMirage prohibits the upload, generation, or distribution of any content that depicts, is derived from, or is intended to resemble any real, identifiable person, including any content produced from photographs, video, or other source material of actual human beings. This prohibition is set out in the Content Policy and applies without exception.

The prohibition is enforced through an automated safety pipeline applied to every upload before publication, combined with human review. Content found to depict or be derived from a real person is removed, and the responsible account is subject to enforcement up to and including permanent termination, as described in the Content Policy and the Complaints and Content Removal Policy.

3. Age Standards for Synthetic Content

Independently of the record-keeping regime addressed above, RealMirage enforces strict age standards at the level of the depiction itself. Every upload is screened, before publication, by automated systems that assess apparent age, and all content on the Platform must depict characters who are unambiguously adult in appearance. Content that fails this standard, or that cannot be affirmatively cleared by the screening pipeline, is withheld from publication.

Material that sexualizes minors — including wholly fictional or synthetic depictions — is illegal under the laws applicable to the Platform, including section 163.1 of the Criminal Code of Canada, and is prohibited absolutely. Suspected material of this kind is quarantined, preserved, and reported in accordance with the Platform's mandatory reporting obligations.

4. Platform Role

RealMirage is a distribution platform. Content published on the Platform is created and uploaded by independent Studio creators using off-platform tools; the Platform provides no image or video generation or editing tools. To the extent any record-keeping regime were asserted to apply to any item of content notwithstanding Section 1, Darwin AI Technologies Ltd. does not produce that content and is not a producer of it; responsibility for the creation of content rests with the uploading Studio, which certifies at upload that the content is wholly AI-generated and complies with the Content Policy.
